easycarloan.online is owned and operated by EMBR Group Pty Ltd (ABN 27 147 278 153) (“EMBR”, “we”, “us” or “our”).
These Terms & Conditions apply to your use of easycarloan.online (the “Website”).
By accessing the Website or submitting an enquiry, you agree to these Terms and acknowledge our Privacy Policy.
1. Eligibility
The Website is intended for Australian residents aged 18 years or over.
By submitting an enquiry, you confirm that the information you provide is accurate to the best of your knowledge.
2. Nature of the Service
Easy Car Loan is a car-loan enquiry and referral service operated by EMBR. EMBR generates and refers enquiries only.
We collect enquiries from consumers interested in obtaining vehicle finance and may refer qualifying enquiries to independent lenders, finance brokers or other appropriately licensed or authorised credit service providers (“Referral Partners”).
EMBR is not a lender or a credit assistance provider. Through this Website, EMBR does not provide credit or credit assistance, and does not guarantee, approve, recommend or arrange a loan.
Any loan application, credit assistance, assessment, recommendation or lending service resulting from your enquiry is provided by the relevant Referral Partner or lender under its own licence or authorisation.
3. Qualification and Referral of Enquiries
Not every enquiry submitted through the Website will necessarily be referred.
We may use information you provide, including the loan amount you are seeking, to determine whether your enquiry meets the minimum criteria for referral.
We may use automated systems and predefined business rules to assist with this process.
Where more than one Referral Partner is capable of receiving an enquiry, our systems may route the enquiry according to factors such as:
- the loan amount requested;
- the Referral Partner's acceptance criteria;
- the type of enquiry;
- the Referral Partner's current availability or enquiry volume; and
- other operational requirements of our referral arrangements.
Submission of an enquiry does not guarantee that you will be referred, offered finance or approved for a loan.
4. One Referral Partner Per Enquiry
Where your enquiry is referred, we generally provide it to one Referral Partner only.
That Referral Partner compares up to 40 lenders when it considers your finance requirements. We do not ourselves compare lenders or loans.
We do not operate this service by simultaneously sending your enquiry to multiple lenders or brokers to obtain competing quotes.
Different consumers may be referred to different Referral Partners depending on applicable referral criteria and the Referral Partner's availability at the time.
5. Referral Partners
Referral Partners operate independently of EMBR.
The Referral Partner receiving your enquiry may contact you to obtain additional information, discuss your finance requirements and, where appropriate, assist you with a credit application.
Any loan product, interest rate, fees, eligibility criteria, credit assessment or recommendation will be subject to the Referral Partner's own processes and the requirements of the relevant lender.
You should review all applicable terms, fees, rates and disclosure documents before entering into any credit contract.
6. No Guarantee of Approval, Rate or Savings
Submitting an enquiry through Easy Car Loan does not guarantee:
- approval for finance;
- that a particular lender or product will be available;
- any particular interest rate, repayment or fee;
- that you will receive multiple loan offers or quotes; or
- that a particular loan will be the cheapest or most suitable option available in the market.
Credit approval is subject to the relevant lender's criteria and assessment.
7. Our Remuneration
EMBR receives a fixed fee for qualifying enquiries referred to a Referral Partner.
Our referral fee is not calculated by reference to:
- whether your finance application is approved;
- whether you ultimately obtain a loan;
- the interest rate you receive;
- the amount ultimately funded; or
- the ongoing performance of your loan.
You are not charged by EMBR merely for submitting an enquiry through this Website.
A Referral Partner may have its own fees, charges or remuneration arrangements, which it must disclose to you where required.
8. General Information Only
Information provided on the Website is general in nature and does not take into account your individual financial situation, requirements or objectives.
EMBR does not provide personalised credit assistance, loan recommendations or credit assessments. These are provided only by an appropriately licensed or authorised Referral Partner or lender.
You should consider the relevant credit guide, proposal document, loan terms and other disclosures provided to you before proceeding.
9. Contact Consent
By submitting your details and providing the relevant consent, you agree that EMBR and/or the Referral Partner selected for your enquiry may contact you by telephone, SMS or email in connection with your car-loan enquiry.
You may withdraw this consent at any time.
Any email or SMS we send will tell you how to opt out.
10. Intellectual Property
Unless otherwise stated, the Website and its content, including branding, text, design, graphics and software, are owned by or licensed to EMBR.
You may use the Website for personal purposes but must not reproduce, commercially distribute or otherwise exploit Website content without our written permission.
11. Website Availability and Accuracy
We take reasonable steps to maintain accurate Website information but do not guarantee that all content will always be current, complete or error-free.
Lender criteria, products, interest rates, fees and Referral Partner arrangements can change.
We do not guarantee uninterrupted access to the Website.
12. Liability
To the maximum extent permitted by law, EMBR is not responsible for services independently provided by a Referral Partner or lender.
Nothing in these Terms excludes, restricts or modifies any right, consumer guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law, National Credit Act or other applicable law.
13. Privacy
We handle personal information in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use and disclose your information, including the use of automated systems to qualify and route enquiries to Referral Partners.
14. Changes to These Terms
We may update these Terms from time to time.
The current version will be published on the Website together with the date it was last updated.
Changes apply from publication and do not retrospectively alter rights or obligations that have already arisen.
15. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts of Victoria.
